BUILDING CONTRACTING PROCEDURES

The enterprises that undertake the construction of a building that will be owned by others are called “Construction Contracting Enterprises”. As it is understood from the definition, construction contracting companies undertake construction activities on behalf of real and legal persons who want to have construction. This relationship starts with a contract to be made between the employer (the real or legal person who will have the construction done) and the construction contracting company. Before the contract to be made between the employer and the construction contracting companies regarding the construction of the building, there are some procedures that the employer must do:

Preparation of the project,
Determining the cost of discovery,
Determination of the pricing method,
Determination of the method of getting an offer,
Tender of the project
Bids are submitted by contracting companies for the project that has been put out to tender. The bids submitted are evaluated by the employer, and a contract is signed with the construction contracting company that gives the most appropriate offer and construction begins.

1. The Process Followed in Construction Commitments: 1.1 Preparation of the Project: The first thing to be done in the construction contracting works is the preparation of the project for the construction to be done. The project is prepared by the employer, that is, the person who will have the construction done, or it is prepared by experts in this field. If the business owner employs someone who is responsible for preparing the project, the project is prepared by this person. If the business owner does not employ such a person, he/she has the project prepared by specialized institutions in this field.

In order for the planned construction to be put out to tender:

The land has been provided
Ownership and expropriation procedures have been completed,
Building permits have been obtained,
The project must be prepared. Projects consist of several plans:
Site Plan: These are the plans in which the dimensions of the land, the layout of the building, the distance from the environment (neighboring land, avenue, street, etc.) and the road level are specified.
Floor Plan: These are the plans that show the dimensions of the rooms and various sections in the building, as well as elements such as stairs, lighting space, chimney.
Sections: It is the plan that shows the details of the resulting image, assuming that the building to be built is cut vertically and horizontally.
Appearance Plans: These are the plans that give the view of the building to be built from all sides.
Installation Plans: These are the plans showing the pictures and locations of the installations such as electricity, water, heating, ventilation, elevator and cooling.
Detail Plans: These are the pictures drawn in order to indicate in detail the nodal points of the various elements that make up the building to be built.
The projects that will be created according to the course of construction by using the above plans are as follows: Preliminary Projects (Preliminary Project): The first project to be prepared regarding the construction is a draft project, and this project;
Ground surveys of the land,
basic studies,
Situation plan,
floor and roof plans,
It consists of a report in which the architectural appearance of the construction will take place. Final Projects: After the preliminary project of the building is approved, all units are dimensioned and detailed. Thus, the final project is prepared. In other words, the final project is the project created by reviewing the preliminary project in terms of its technical features. Application Projects: After the final projects are approved, the application project is prepared in accordance with the details, in which the architectural elements, the dimensions of the installation and other details are shown. This project consists of sub-projects such as architectural, static and installation projects.

1.2. Determination of Exploration Fee: After the project is prepared, the estimated cost of the construction planned to be done is determined. The total cost of the construction is determined by adding the profit of the contracting company to this cost. Detection of the cost of exploration as under or over causes various problems. For this reason, it is very important to calculate the cost of the construction correctly while determining the estimate price. All expenses to be made in determining the cost of the survey can be determined in detail, as well as the unit price lists determined for the works in the projects or the minimum construction square meter unit prices. The discovery that shows the cost of construction in items is called the first survey.

1.3. Determination of Pricing Method: After determining the estimated cost (exploration cost) of the construction that is planned to be built, the pricing method to be used in the evaluation of the works to be done by the contracting companies (contractor company) must be determined. Since this pricing method to be determined will be included in the contract to be signed with the contracting company that will win the tender, this method must be determined by the employer (the employer) before the work is awarded. If the pricing method is not specified in the contract, then the provisions of the Code of Obligations are applied. According to this; “If the price has not been determined in advance or has been decided in an approximate way to be determined according to the value of the work, it is determined according to the value of the work done and the cost of the contractor”. Pricing methods are:
